Statutory Information


As you will be aware, on 23 September 2019, the High Court appointed the Official Receiver as liquidator over a number of entities in the Thomas Cook group on the petition of the companies’ directors. Simultaneously, the Court also appointed Simon Appell, Alastair Beveridge, Daniel Imison, and Ben Browne as Special Managers to support the liquidator.

Restructuring professionals from Interpath Advisory (Interpath) were also appointed by the Court as Special Managers of Thomas Cook Retail Limited, Travel and Financial Services Limited, TCCT Retail Limited, Retail Travel Limited, Thomas Cook Aircraft Engineering Limited, The Freedom Travel Group Limited and Future Travel Limited.

Under UK insolvency law there is no provision for a creditors or liquidation committee to be formed in a case when the court has made a compulsory winding up order and the Official Receiver (a statutory office holder employed by the government) is appointed as liquidator, as has happened with the Thomas Cook group companies. Therefore, creditors cannot request the formation of such a committee.
